TERMS & CONDITIONS OF SERVICE
Customer, Driver & Platform Agreement
Effective Date: September 1, 2026
These Terms & Conditions ("Terms," "Agreement," or "Terms of Service") govern access to and use of TenDollarTrip.com, including its website, digital booking system, mobile web applications, software, transportation marketplace, driver platform, customer platform, communications systems, and related services (collectively, the "Platform").
The Platform is operated by TenDollarTrip.com ("TenDollarTrip," "Company," "we," "us," or "our").
By accessing the Platform, creating an account, requesting or accepting a ride, becoming a member, driving for TenDollarTrip, or otherwise using any TenDollarTrip service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you may not use the Platform or TenDollarTrip services.
1. IMPORTANT LEGAL NOTICE
TenDollarTrip is a transportation technology and ride-arrangement platform.
To the extent permitted by applicable law, TenDollarTrip's role is to provide the digital technology and marketplace through which riders and drivers may be connected for prearranged transportation services.
Nothing in these Terms is intended to waive, eliminate, or reduce any right, obligation, insurance requirement, safety requirement, consumer protection, or other protection that cannot legally be waived under applicable federal, state, or local law.
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
2. ELIGIBILITY
To use TenDollarTrip as a rider, you must:
Be legally capable of entering into a binding agreement;
Provide accurate account information;
Provide accurate pickup and destination information;
Comply with all applicable laws;
Treat drivers and other riders respectfully;
Not use the Platform for unlawful purposes; and
Comply with all applicable TenDollarTrip policies.
Drivers must satisfy all eligibility requirements established by TenDollarTrip and all requirements imposed by applicable law.
TenDollarTrip may deny, suspend, restrict, or terminate access to the Platform when permitted by law.
3. DRIVER INDEPENDENT CONTRACTOR STATUS
To the extent permitted by applicable law, a driver providing transportation through TenDollarTrip is an independent contractor and is not an employee, partner, joint venturer, agent, franchisee, or representative of TenDollarTrip.
Nothing in these Terms creates an employment relationship.
Drivers are responsible for determining when and whether they make themselves available through the Platform, subject to applicable law and the terms of their driver agreement.
Drivers may provide services through other transportation platforms and may engage in other lawful occupations or businesses.
Drivers are responsible for their own taxes, expenses, vehicle costs, fuel, maintenance, insurance, licensing, permits, and other expenses associated with operating their vehicle, except where TenDollarTrip is legally required to provide or pay for a particular item.
4. DRIVER REQUIREMENTS
Before receiving authorization to provide transportation through TenDollarTrip, drivers may be required to provide and maintain:
Valid driver's license;
Valid vehicle registration;
Proof of required insurance;
Proof of vehicle eligibility;
Required inspections;
Background-check authorization;
Driving-record authorization;
Accurate personal information;
Accurate vehicle information;
Any legally required permits or documentation.
TenDollarTrip may conduct initial and periodic verification of driver eligibility as required by law or Company policy.
Drivers must immediately notify TenDollarTrip of any event that could affect their eligibility, including suspension or expiration of a driver's license, insurance cancellation, vehicle registration expiration, criminal charges or convictions when legally reportable, serious traffic violations, or other circumstances that may affect eligibility.
5. DRIVER INSURANCE
Drivers must maintain all insurance required by applicable law.
Where Delaware's Transportation Network Company statutes apply, the applicable statutory insurance requirements must be satisfied.
Delaware law currently requires specified coverage while a TNC driver is logged onto the platform and while the driver is engaged in a prearranged ride, including at least $1,000,000 in primary automobile liability coverage during a prearranged ride, subject to the statutory requirements and permitted methods of satisfying those requirements.
Drivers must carry proof of applicable insurance while operating in connection with the Platform.
TenDollarTrip may require additional insurance documentation when reasonably necessary to verify legal compliance.
Nothing in these Terms guarantees that a driver's personal automobile insurance policy will cover transportation-for-compensation activities.
Drivers are solely responsible for determining whether their personal automobile insurance permits transportation-for-compensation activity and for obtaining any required TNC endorsement or other appropriate coverage.
6. VEHICLE RESPONSIBILITY
Drivers are solely responsible for maintaining their vehicles in safe operating condition.
Drivers must comply with all applicable vehicle inspection, registration, maintenance, equipment, and safety requirements.
TenDollarTrip may prohibit a vehicle from being used through the Platform when the Company reasonably believes that the vehicle does not satisfy applicable safety or eligibility requirements.
Drivers may not knowingly operate a vehicle that is unsafe, illegally registered, uninsured, improperly maintained, or otherwise prohibited by applicable law.
7. RIDER RESPONSIBILITIES
Riders must:
Enter accurate pickup and destination information;
Be present at the designated pickup location;
Behave safely and respectfully;
Follow applicable laws;
Follow reasonable driver safety instructions;
Not damage the driver's vehicle;
Not threaten, assault, harass, or intimidate a driver;
Not possess prohibited or illegal items in the vehicle;
Not intentionally provide fraudulent account or payment information; and
Not interfere with the driver's ability to safely operate the vehicle.
Riders are responsible for their personal belongings.
TenDollarTrip and drivers are not responsible for lost, stolen, or damaged personal property except to the extent liability cannot legally be excluded.
8. PROHIBITED CONDUCT
The following conduct is prohibited:
Violence or threats of violence;
Sexual harassment or sexual misconduct;
Harassment or intimidation;
Discrimination prohibited by law;
Fraud;
Account sharing;
Identity misrepresentation;
Theft;
Property damage;
Use of the Platform for unlawful activity;
Possession or transportation of prohibited items;
Unauthorized transportation of additional persons when prohibited by the booking;
Manipulation of the Platform;
Circumvention of TenDollarTrip fees;
False complaints;
False accident claims;
Fraudulent chargebacks;
Attempting to obtain unauthorized refunds;
Unauthorized recording or publication of private information where prohibited by law;
Interference with GPS, payment, booking, or Platform technology; and
Any conduct that creates an unreasonable safety risk.
TenDollarTrip may suspend or terminate an account for prohibited conduct, subject to applicable law.
9. ZERO-TOLERANCE DRUG AND ALCOHOL POLICY
TenDollarTrip maintains a zero-tolerance policy regarding driver use of alcohol or drugs while providing transportation services or while otherwise subject to applicable platform restrictions.
A rider who reasonably suspects that a driver is operating under the influence may report the concern to TenDollarTrip.
Upon receiving an appropriate complaint, TenDollarTrip may immediately suspend the driver's access to the Platform while the Company investigates the complaint, as required by applicable law.
Drivers are prohibited from providing transportation while impaired.
10. NONDISCRIMINATION
TenDollarTrip prohibits unlawful discrimination against riders, prospective riders, and drivers.
Drivers and riders must comply with applicable nondiscrimination laws.
TenDollarTrip will not knowingly permit discrimination based on legally protected characteristics.
Nothing in these Terms prevents TenDollarTrip from taking lawful safety measures, conducting lawful eligibility screening, or complying with applicable law.
11. SERVICE ANIMALS AND ACCESSIBILITY
TenDollarTrip and its drivers will comply with applicable laws concerning persons with disabilities and service animals.
Drivers may not impose an additional charge solely because a rider has a disability or requires a service animal when prohibited by applicable law.
12. RIDE ACCEPTANCE
A ride request does not necessarily create a transportation contract until the ride has been accepted through the Platform.
Drivers may accept or decline requests subject to applicable law and TenDollarTrip policies.
Once a driver accepts a ride, the driver is expected to make reasonable efforts to complete the ride unless safety concerns, emergencies, legal restrictions, or other legitimate circumstances prevent completion.
13. PICKUP AND WAITING PERIODS
Riders are responsible for being reasonably available at the designated pickup location.
Drivers may wait for the applicable pickup period established by TenDollarTrip.
A rider who is not available within the applicable waiting period may be subject to cancellation or other applicable charges.
Drivers may not intentionally mark a rider as absent when the driver has not reasonably attempted to locate the rider.
14. CANCELLATIONS
TenDollarTrip may establish cancellation policies and fees.
Cancellation fees, where applicable, are intended to compensate for reasonable costs associated with driver time, dispatching, payment processing, and other operational expenses.
TenDollarTrip may waive or modify cancellation fees when appropriate.
Nothing in this section limits rights that cannot legally be waived.
15. FARES AND PAYMENTS
Fares are determined according to the pricing displayed or otherwise communicated through the Platform.
Before completing a booking, the rider may be shown applicable pricing information, subject to circumstances that may legally permit fare adjustments.
TenDollarTrip may use third-party payment processors.
Riders authorize TenDollarTrip and its payment processors to charge applicable amounts associated with authorized transactions.
A rider may not initiate a fraudulent or unauthorized chargeback.
If a rider disputes a transaction, the rider should first contact TenDollarTrip so that the Company may investigate the transaction.
TenDollarTrip reserves the right to contest fraudulent or improper chargebacks.
IMPORTANT: All payment methods and fare structures offered by TenDollarTrip shall be operated in accordance with applicable Delaware transportation laws and regulations.
Where Delaware's TNC laws apply, TenDollarTrip will comply with the statutory requirements governing payment of prearranged rides.
16. MEMBERSHIPS AND SUBSCRIPTIONS
TenDollarTrip may offer membership or subscription programs.
Membership benefits, pricing, renewal periods, cancellation rights, and ride pricing may be changed upon reasonable notice.
Membership does not guarantee ride availability.
Membership does not guarantee a particular driver.
Membership does not guarantee a particular pickup time unless expressly confirmed through the Platform.
TenDollarTrip may suspend or terminate membership for fraud, abuse, nonpayment, violation of these Terms, or other lawful reasons.
17. DRIVER COMPENSATION
Drivers are compensated according to the applicable driver compensation agreement and compensation schedule provided by TenDollarTrip.
Driver compensation may be modified prospectively upon reasonable notice.
Drivers are responsible for reviewing their compensation terms before accepting transportation requests.
Nothing in these Terms guarantees any minimum number of rides, minimum earnings, minimum hours, or minimum income unless expressly stated in a separate written agreement.
18. NO GUARANTEE OF AVAILABILITY
TenDollarTrip does not guarantee:
A driver will always be available;
A rider will always receive a ride;
A particular driver will accept a request;
A ride will arrive at a specific time unless expressly guaranteed;
The Platform will always be available;
GPS information will always be accurate;
Map information will always be accurate; or
The Platform will operate without interruption.
Transportation may be affected by weather, traffic, road closures, vehicle problems, emergencies, technology failures, driver availability, and circumstances beyond TenDollarTrip's reasonable control.
19. TECHNOLOGY AND GPS
The Platform may use GPS, mapping services, location information, routing technology, mobile-device information, and third-party technology.
GPS and mapping information may contain inaccuracies.
Drivers are responsible for safely operating their vehicles and must comply with traffic laws regardless of directions provided by the Platform.
Drivers must never operate a vehicle while using a mobile device in a manner prohibited by law.
20. THIRD-PARTY SERVICES
TenDollarTrip may rely upon third-party services, including:
Payment processors;
Mapping providers;
GPS services;
Hosting providers;
Telecommunications providers;
Identity verification services;
Background-check providers;
Insurance providers;
Notification services; and
Other technology providers.
TenDollarTrip is not responsible for interruptions or failures caused solely by third-party services, except to the extent required by applicable law.
21. PERSONAL PROPERTY
Riders are responsible for their personal belongings.
Drivers should make reasonable efforts to return property found in their vehicles.
TenDollarTrip may assist in communicating between riders and drivers regarding lost property but does not guarantee recovery.
22. ACCIDENTS AND EMERGENCIES
In an emergency, individuals should first contact the appropriate emergency services.
Drivers must comply with all legal requirements concerning accidents.
Drivers must promptly notify TenDollarTrip of accidents occurring during a TenDollarTrip ride or while otherwise subject to applicable reporting requirements.
TenDollarTrip may request relevant documentation, photographs, insurance information, police reports, and other information reasonably necessary to investigate an incident.
Nothing in these Terms prevents a person from reporting an accident to law enforcement, an insurer, a regulator, or another legally authorized entity.
23. RELEASE OF CLAIMS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH RIDER AND DRIVER AGREES THAT TENdOLLARTRIP SHALL NOT BE RESPONSIBLE FOR CLAIMS ARISING SOLELY FROM THE INDEPENDENT ACTIONS, NEGLIGENCE, MISCONDUCT, OR OTHER CONDUCT OF ANOTHER RIDER, DRIVER, OR THIRD PARTY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH USER RELEASES TENdOLLARTRIP FROM CLAIMS ARISING FROM RISKS THAT ARE INHERENT IN OR REASONABLY ASSOCIATED WITH USING THIRD-PARTY TRANSPORTATION SERVICES, INCLUDING TRAFFIC, WEATHER, ROAD CONDITIONS, ACTIONS OF OTHER MOTORISTS, AND CONDUCT OF OTHER USERS.
THIS RELEASE DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE RELEASED OR WAIVED.
24. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENdOLLARTRIP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM OR TRANSPORTATION SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENdOLLARTRIP'S TOTAL LIABILITY ARISING FROM OR RELATING TO A USER'S USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
THE AMOUNT THE USER PAID TO TENdOLLARTRIP FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
THE MAXIMUM AMOUNT OTHERWISE REQUIRED BY APPLICABLE LAW.
Nothing in this provision limits liability that cannot legally be limited.
25. INDEMNIFICATION
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVERS AND RIDERS AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS TENdOLLARTRIP, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, TECHNOLOGY PROVIDERS, AND REPRESENTATIVES FROM CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND REASONABLE ATTORNEYS' FEES ARISING FROM:
Their violation of these Terms;
Their violation of applicable law;
Their fraudulent or intentionally wrongful conduct;
Damage they cause to property;
Their use or misuse of the Platform;
Their unauthorized use of another person's account;
Their failure to maintain required documentation or insurance;
Claims arising from their independent conduct; or
Claims arising from information they knowingly provided that was materially false or misleading.
This provision does not require indemnification for liability caused by TenDollarTrip's own conduct where such indemnification would be prohibited by law.
26. DRIVER-SPECIFIC INDEMNIFICATION
To the maximum extent permitted by law, each driver agrees that TenDollarTrip is not responsible for the driver's independent acts or omissions, including:
Traffic violations;
Vehicle maintenance;
Vehicle defects;
Driver negligence;
Driver misconduct;
Driver criminal conduct;
Driver's failure to maintain required insurance;
Driver's failure to maintain a valid license;
Driver's failure to comply with applicable laws;
Personal tax obligations; or
Unauthorized activities conducted outside the Platform.
This provision does not eliminate any statutory duty imposed upon TenDollarTrip.
27. RIDER-SPECIFIC INDEMNIFICATION
To the maximum extent permitted by law, each rider agrees to indemnify TenDollarTrip for claims arising from the rider's intentional misconduct, fraudulent activity, unlawful conduct, property damage, or violation of these Terms.
28. DISPUTE RESOLUTION
Before initiating litigation, a user agrees to provide TenDollarTrip with written notice of the dispute and a reasonable opportunity to investigate and attempt to resolve the matter.
The notice should describe:
The nature of the dispute;
The date of the incident;
The ride or transaction involved;
The amount claimed, if applicable; and
The requested resolution.
The parties agree to make a good-faith effort to resolve disputes informally.
29. ARBITRATION
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE BETWEEN A USER AND TENDOLLARTRIP ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, OR SERVICES SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, EXCEPT WHERE APPLICABLE LAW EXPRESSLY PERMITS THE CLAIM TO PROCEED IN COURT.
THE ARBITRATION SHALL BE CONDUCTED BY A NEUTRAL ARBITRATOR UNDER THE APPLICABLE ARBITRATION RULES.
THE PARTIES AGREE THAT CLAIMS SHALL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION OR REPRESENTATIVE ACTION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in this provision prevents a user from:
Filing a claim in a court where applicable law prohibits mandatory arbitration;
Pursuing a legally protected administrative or regulatory complaint;
Reporting unlawful conduct to a governmental agency; or
Exercising any other right that cannot legally be waived.
30. CLASS ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, USERS AGREE THAT THEY WILL NOT PARTICIPATE IN A CLASS ACTION AGAINST TENDOLLARTRIP ARISING FROM OR RELATING TO THE PLATFORM OR SERVICES.
A USER MAY ONLY PURSUE CLAIMS AGAINST TENDOLLARTRIP IN THE USER'S INDIVIDUAL CAPACITY.
This provision applies only to the extent enforceable under applicable law.
31. GOVERNING LAW
These Terms shall be governed by applicable law, including applicable Delaware law, without regard to conflict-of-law principles, except to the extent federal law or mandatory law requires otherwise.
Nothing in this provision prevents application of mandatory consumer-protection, employment, transportation, civil-rights, disability, or other laws that cannot legally be waived.
32. VENUE
To the extent a dispute is legally permitted to proceed in court, venue shall be determined according to applicable law.
Nothing in these Terms prevents a consumer from exercising a legally protected right to bring a claim in a court or forum that cannot legally be waived.
33. ACCOUNT SUSPENSION AND TERMINATION
TenDollarTrip may suspend or terminate a user's access when reasonably necessary for:
Safety;
Fraud prevention;
Payment issues;
Violation of these Terms;
Suspected unlawful conduct;
Driver eligibility concerns;
Insurance concerns;
Repeated cancellation abuse;
Threatening or abusive conduct;
Platform manipulation; or
Compliance with applicable law.
Where appropriate and legally required, TenDollarTrip may provide an opportunity to appeal a suspension or termination.
34. NO RETALIATION FOR GOOD-FAITH REPORTS
TenDollarTrip does not prohibit users from making good-faith reports of suspected safety violations, discrimination, criminal activity, accidents, or legal violations.
False, fraudulent, knowingly misleading, or malicious reports may violate these Terms.
Nothing in these Terms prevents a person from exercising a legally protected right.
35. PRIVACY
TenDollarTrip may collect and process information necessary to operate the Platform, including account information, transaction information, ride information, location information, communications, device information, and other information described in the Company's Privacy Policy.
The TenDollarTrip Privacy Policy is incorporated into these Terms by reference.
Users should review the Privacy Policy before using the Platform.
36. RECORDING AND COMMUNICATIONS
To the extent permitted by law, communications between users and TenDollarTrip may be recorded, stored, or reviewed for customer service, safety, fraud prevention, dispute resolution, quality assurance, and legal compliance.
Nothing in this section authorizes recording where prohibited by applicable law.
37. ELECTRONIC COMMUNICATIONS
By using TenDollarTrip, users consent to receive electronic communications concerning:
Ride requests;
Ride status;
Payments;
Account activity;
Safety issues;
Customer service;
Policy updates; and
Other service-related communications.
Marketing communications may be subject to separate consent and applicable law.
38. USER CONTENT
Users may submit reviews, comments, photographs, complaints, feedback, or other content.
Users retain ownership of content they own, but grant TenDollarTrip a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, and process such content as reasonably necessary to operate, improve, protect, and promote the Platform, subject to applicable privacy laws.
TenDollarTrip may remove content that violates these Terms or applicable law.
39. INTELLECTUAL PROPERTY
The TenDollarTrip name, logo, website design, software, graphics, text, trademarks, branding, systems, and other Company materials are owned by or licensed to TenDollarTrip and may not be copied, reproduced, modified, distributed, or commercially exploited without authorization.
40. PLATFORM SECURITY
Users may not attempt to:
Access unauthorized systems;
Reverse engineer the Platform;
Circumvent security measures;
Introduce malicious software;
Manipulate ride records;
Manipulate GPS information;
Manipulate payment information;
Scrape protected Platform data; or
Interfere with Platform operations.
41. FORCE MAJEURE
TenDollarTrip shall not be responsible for delays, interruptions, or failures caused by circumstances outside the Company's reasonable control, including:
Severe weather;
Natural disasters;
Traffic emergencies;
Road closures;
Government action;
Telecommunications failures;
Internet outages;
Cybersecurity incidents;
Payment processor failures;
Utility failures;
Labor disruptions;
Public emergencies; or
Other events beyond the Company's reasonable control.
42. CHANGES TO THESE TERMS
TenDollarTrip may update these Terms when reasonably necessary.
Updated Terms may be posted on the Platform.
Where legally required, TenDollarTrip will provide additional notice or obtain additional consent.
Continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.
43. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in effect.
44. NO WAIVER
Failure by TenDollarTrip to enforce a provision of these Terms does not constitute a waiver of the Company's right to enforce that provision later.
45. ENTIRE AGREEMENT
These Terms, together with applicable driver agreements, membership agreements, Privacy Policy, posted policies, fare policies, and other incorporated agreements, constitute the agreement between the user and TenDollarTrip concerning use of the Platform.
If a separate written agreement conflicts with these Terms, the separate agreement controls to the extent expressly stated.
46. ELECTRONIC ACCEPTANCE
By creating an account, clicking an acceptance button, booking a ride, accepting a ride as a driver, becoming a member, or otherwise using the Platform after being presented with these Terms, the user acknowledges that the user has had an opportunity to review these Terms and agrees to be bound by them to the maximum extent permitted by law.
Electronic acceptance may constitute an electronic signature where legally recognized.
47. DRIVER ACKNOWLEDGMENT
By becoming a TenDollarTrip driver, the driver specifically acknowledges:
"I understand that I am responsible for complying with all applicable laws, maintaining required licenses, registration, insurance, vehicle safety requirements, and eligibility requirements. I understand that I am an independent contractor to the extent permitted by applicable law and that I am responsible for my own taxes and business expenses. I understand that TenDollarTrip does not guarantee a minimum number of rides or income. I understand that I may be removed from the Platform for safety, eligibility, legal, insurance, fraud, or policy reasons."
48. RIDER ACKNOWLEDGMENT
By using TenDollarTrip, the rider specifically acknowledges:
"I understand that transportation involves inherent risks, including traffic, weather, road conditions, vehicle accidents, and actions of other people. I agree to comply with these Terms and applicable laws and to treat drivers respectfully. I understand that TenDollarTrip uses independent drivers and third-party technology and that certain risks and liabilities may be allocated according to these Terms and applicable law."
49. DELAWARE TNC COMPLIANCE
Where TenDollarTrip qualifies as and operates as a Transportation Network Company under Delaware law, TenDollarTrip intends to comply with the applicable provisions of Delaware's Transportation Network Company statutes, including requirements concerning:
TNC permitting;
Driver eligibility;
Background checks;
Driving-record checks;
Vehicle safety;
Insurance;
Driver disclosures;
Drug and alcohol zero-tolerance requirements;
Nondiscrimination;
Accessibility;
Trip records;
Payment requirements; and
